Terms of Service

1. About these terms
These terms govern your use of Hiragana Trial ("the Service"). They form the content of the contract for using the Service, as standard terms under Japanese civil law.
By using the Service you agree to them.
2. Who it is for, and the parent's role
- The Service is a learning app for children aged 3–5
- A child cannot be a party to these terms. Creating an account, changing settings, and
subscribing to email are all actions for a parent or guardian
- The parent is responsible for their child's use of the Service
3. Accounts
- An account is optional. Every feature works without one
- Keeping the password safe is the parent's responsibility
- A child's display name and username do not have to be a real name, and we recommend
they are not
4. Price
The Service is currently free.
If we ever add paid features, we will publish updated terms and pricing before doing so, and give notice under §12. We will not make an existing free feature paid without notice.
5. What you must not do
- Interfere with the Service (excessive automated access, exploiting vulnerabilities, etc.)
- Copy, redistribute, or sell the Service's content without permission
- Infringe the rights of other users or third parties
- Break the law
6. Content and rights
- The illustrations, audio, text, and software of the Service belong to us or to the
respective rights holders
- The following are governed by their own licences:

- Drawings your child makes in the app belong to your child. They are stored on the
device only; we never receive them
7. Coins and items
The in-app "coins" and cosmetic items are a display mechanism to motivate learning.
- They have no monetary value
- They cannot be bought, exchanged for money, transferred, or refunded
- We may change how many are earned, and what things cost, to tune the pacing
8. Moving on to our sister service
A child who finishes the Service may move on to Kanji Trial. Kanji Trial is a separate service with its own terms and privacy policy. For what is passed across, see Privacy Policy §7.
9. The nature of the Service
Please note the following. These are descriptions of what the Service is; they do not release us from liability.
- The Service is provided as is, and we do not guarantee any learning outcome
- Progress stored on your device can be lost — for example if browser data is cleared —
and we have no way to restore it (Privacy Policy §2.1)
- The Service does not provide medical or developmental diagnosis or advice. If you
have concerns about your child's development, please consult a professional
- Availability may be interrupted by network conditions, devices, or browsers
10. Limitation of liability
We are liable for damages of the kind that would ordinarily arise from our provision of the Service.
Given that the Service is provided free of charge, the total amount we will pay is limited to the amount you have paid for the Service in the preceding 12 months.
### This section does not apply where we have acted intentionally or with gross negligence.
Nor does this section limit any liability that cannot be limited by law, including liability for death or personal injury.
11. Changes to, or withdrawal of, the Service
We may change the Service or stop providing it. If we stop, we will announce it on this site as far in advance as we reasonably can.
12. Changes to these terms
We may change these terms where either:
- the change is in the general interest of users; or
- the change is consistent with the purpose of these terms and is reasonable, having
regard to the need for the change, the appropriateness of the changed content, and other circumstances.
In case 2, we will post the changed content and the date it takes effect on this page at least 30 days beforehand, and email parents who have opted into the weekly email.
13. Governing law
These terms and your contract to use the Service are governed by Japanese law.
However, if you use the Service as a consumer, this does not deprive you of the protection of any provisions of the law of your country or region of habitual residence that cannot be excluded by agreement.
14. Jurisdiction
Any dispute between us and a user relating to the Service shall be brought before the Tokyo District Court as the court of first instance by agreement.
However, this does not exclude the jurisdiction of the courts of your place of residence or any other court where the law gives them jurisdiction.
